These Terms of Service (“Terms”) constitute a legally binding agreement governing your access to and use of the services provided by Second Insight / V-Healthcare Solutions (“Platform”, “Company”, “we”, “our”, “us”).

By accessing, registering, communicating with, or using the Platform in any manner (including via WhatsApp, phone, web, or CRM interactions), you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Platform Identity & Legal Nature

1.1 Nature of Business
The Platform operates as a healthcare coordination, consultation facilitation, and care-enablement system. It exists to reduce uncertainty, improve access, and coordinate execution — not to practice medicine.

1.2 No Practice of Medicine
The Platform does not diagnose, treat, prescribe, or provide medical care. At no point does the Platform assume clinical responsibility.

1.3 Independent Medical Practitioners
All doctors accessible through the Platform act as independent licensed practitioners. They are not employees, agents, or representatives of the Platform.

2. Eligibility, Authority & Representation

2.1 User Eligibility

  • You must be at least 18 years of age, or
  • You must be a caregiver, parent, or legal guardian authorized to act on behalf of a patient

2.2 Authority to Act
If you act on behalf of another person, you represent and warrant that you are legally authorized to do so.

2.3 Accuracy of Information
You are solely responsible for ensuring that all information, documents, and representations you provide are accurate, current, and complete.

3. Emergency Exclusion (Hard Boundary)

  • The Platform is not designed for medical emergencies.
  • You must not use the Platform for conditions requiring immediate or life-saving intervention.
  • In an emergency, contact local emergency services or visit the nearest hospital.
  • The Platform bears no responsibility for harm arising from misuse in emergencies.

4. Service Categories & Scope

4.1 Second Opinion / Consultation Services

  • Collection and organization of medical information
  • Routing to appropriate independent specialists
  • Scheduling and communication facilitation

The Platform does not validate, modify, summarize, or endorse medical opinions.

4.2 Diagnostic Coordination Services

  • Coordination with diagnostic partners
  • Home collection or center visit facilitation
  • Report delivery coordination

Interpretation of diagnostic results remains solely between doctor and patient.

4.3 Health Assist (Care Coordination) Services

  • Doctor and hospital scheduling
  • Admission and discharge coordination
  • Insurance and documentation support
  • Non-clinical patient navigation

Medical decision-making always remains with the treating doctor and patient.

5. Case Flow, Stages & Responsibility Transfer

  • The Platform operates using defined case stages.
  • Stage movement reflects operational responsibility, not medical ownership.
  • The Platform may pause, reject, or close cases for safety, scope, or risk reasons.

6. Consent Framework

  • Consent is case-specific, purpose-bound, and time-stamped.
  • Consent is required before processing any medical data.
  • Withdrawal of consent may result in service termination.

7. Doctor Relationship & Boundaries

  • Doctors may accept or refuse cases at their discretion.
  • Doctors act under their own licenses and judgment.
  • The Platform does not rank doctors by medical quality or outcomes.

8. Payments, Fees & Commercial Structure

  • Certain services require advance payment.
  • Fees may include consultation, diagnostic, or coordination charges.
  • Health Assist may involve patient-paid and/or provider-paid fees.
  • Payments are not outcome-linked.

9. User Obligations & Prohibited Conduct

  • No misrepresentation of identity or medical records
  • No unauthorized sharing of third-party records
  • No illegal, deceptive, or abusive use

10. No Guarantees or Warranties

Services are provided on an “as-is” and “as-available” basis. No guarantees are made regarding outcomes, accuracy, or timelines.

11. Limitation of Liability

  • No liability for medical outcomes or provider actions
  • Liability capped at the amount paid for the specific service
  • No indirect or consequential damages

12. Indemnification

You agree to indemnify and hold harmless the Platform against claims arising from misuse, violations, or unauthorized data sharing.

13. Data Protection & Privacy

All data is handled in accordance with the Platform’s Privacy Policy. Use of the Platform constitutes acceptance of those practices.

14. Suspension, Termination & Case Freezing

The Platform may suspend or terminate services if risk, legal exposure, or consent withdrawal occurs.

15. Intellectual Property

All Platform systems, workflows, and content are proprietary. No rights are granted beyond limited service access.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of Indian courts.

17. Modifications

The Platform may revise these Terms periodically. Continued use constitutes acceptance of updates.
